The relationship between the User and Curious Cat Limited regarding the User's use of the Services is governed by this Agreement and other relevant policies. If the User installs, uses or accesses the Services in other ways, it means that the User accepts the terms of this Agreement. Otherwise, the User may not install, use or access the Services in any other way.
Restrictions:
Our games are intended for adults to play, and we do not intentionally collect information from children, nor do we want to collect information from children. People under the age of 13 may not create an account or access the Services. Users should deny access to the Services to children under the age of 13. Users are fully responsible for any unauthorized use of the Services by minors, including the use of payment instruments such as credit cards or online payment systems such as PayPal.
If the User is between the ages of 13 and 17, the User's legal guardian must review and agree to this Agreement. If the User accesses the Services from an SNS, the User shall comply with its terms of service/use as well as this Agreement.
Prohibitions:
Use the Service if the user has previously been removed by Curious Cat Limited or banned from playing any Curious Cat Limited game;
Create an account using a false identity or information or on behalf of someone other than the user;
Buy, sell, rent or give away user accounts;
Use an account for commercial purposes or to advertise, solicit, transmit commercial advertising to anyone, including chain letters, junk emails, or repetitive or misleading messages.
Amendments to the Agreement
Curious Cat Limited reserves the right to make any amendments to this Agreement and other relevant Curious Cat Limited policies at any time at its sole discretion. The revised version shall be posted on the Curious Cat Limited Service. If the user continues to use the Service, it shall be deemed that the user agrees to the above amendments. The user shall be notified of the changes, and if the user does not agree to the above amendments, the user's license shall terminate immediately and the user shall no longer use the Service.
Limited License:
Subject to this Agreement and other relevant Curious Cat Limited policies, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Services for your non-commercial, entertainment purposes. You may not use the Services for any other purpose.
License Restrictions. Unless you comply with the License Restrictions, your use of the Services is prohibited and we may revoke your license. In addition, you are responsible for any illegal conduct. In any case, you may not:
Violate any law, including but not limited to intellectual property laws;
Take any action that is detrimental to the user community, employees, Curious Cat Limited itself, the spirit or intent of the Services or abuse our Services; including but not limited to posting, publishing, uploading or sharing any information, photos or videos that could be construed as restricted content or violate good etiquette.
Directly or indirectly use cheats, exploits, automated software, robots, hacks, mods or any other unauthorized third-party software to modify or interfere with the Service;
Harm the Service, Curious Cat Limited's computers and servers, and other users, including but not limited to overloading the server, any attack (including spreading viruses), unauthorized access to the Service or any other protected data, manipulating the Service and its rankings, exploiting bugs in the Service, or modifying any files comprising the Service without prior written consent.
Curious Cat Limited may determine in its sole discretion what inappropriate behavior will be considered a violation of this Agreement and take appropriate action, including removing User Content, terminating User accounts, prohibiting Users from using the Service, or taking any other action permitted by law.
Limitation of Liability
To the extent permitted by law, Curious Cat Limited shall not be liable to the User for any damages, including loss of income, loss of profits, loss of data, business interruption or other losses, unless such liability for damages arises from the gross negligence or willful misconduct of Curious Cat Limited, or from death or personal injury caused by any negligence or fraud of Curious Cat Limited. This Agreement does not affect any statutory rights of consumers. The User undertakes to indemnify, defend and hold Curious Cat Limited harmless from any claim, demand, damages or other losses, including reasonable attorneys' fees, made by any third party arising from the User's use of the Services or the User's breach of this Agreement. For the avoidance of doubt, the above provision shall not apply if the infringement is not caused by the User's intentional or negligent behavior.
Applicable Law and Dispute Resolution
This Agreement and any dispute arising out of it or Curious Cat Limited's Privacy Policy or Terms of Service shall be governed in all respects by the laws of Hong Kong. Any claim arising therefrom shall be exclusively resolved by the competent courts of Hong Kong, unless the laws of your country of residence permit you to choose the courts of that country to resolve the relevant dispute. If you are a citizen of the European Union, you may bring an action in the courts of your place of residence. If any dispute arises between the user and Curious Cat Limited, the user is strongly encouraged to first contact Curious Cat Limited directly for resolution.
Severability
If any provision of this Agreement or the Curious Cat Limited Privacy Policy is held by any court of competent jurisdiction to be illegal or unenforceable in whole or in part, such provision shall be ineffective in that jurisdiction only to the extent of such invalidity or unenforceability, and the remaining provisions shall not be affected.
Right of Assignment
Curious Cat Limited may assign this Agreement or the related policies, in whole or in part, to any person or entity at any time without the user's consent. However, the user's assignment of rights or obligations must be approved in writing by Curious Cat Limited in advance before it will be effective.
Additional Policies
Curious Cat Limited may publish additional policies related to its services. Users must agree to and comply with these policies in order to use the services.
Entire Agreement
This Agreement, together with any documents referred to in it (if any), constitutes the entire agreement and understanding between Curious Cat Limited and the User and supersedes any prior agreements or understandings between the parties regarding the subject matter of this Agreement, whether electronic, oral or written, or established by custom, practice, policy or precedent.
Force Majeure
Curious Cat Limited shall not be liable and shall not perform this Contract if the performance of this Contract is interfered with by any circumstances beyond the reasonable control of Curious Cat Limited, including acts of God, industrial disputes or other industrial disturbances, power or power failures, utility or other telecommunications failures, earthquakes, storms or other natural elements, blockades, embargoes, riots, acts of government orders, acts of terrorism or war.
Right to Changes
Curious Cat Limited reserves the right to make changes to this Agreement when necessary, in particular for legal reasons or in connection with changes to the services provided. If this happens, the User shall be notified and Curious Cat Limited shall publish the current wording of this Agreement and the date of the revision on its official website.
